Specific Conditions of Sale and Use
The following general conditions of sale and use may be superceded by specific conditions relating to the sale and use of images for particular purposes. Such specific conditions will be set out in writing and communicated to clients at the time of sale. Printed Photographic Materials
Printed photographic materials may not be reproduced, copied, or stored in any form or format.
Digital Images and Files
Personal License
The Photographer, Leonard John Abrams, grants the buyer a non-exclusive perpetual personal-use license to use, download or copy a purchased image,
subject to the following restrictions:
• This license is for personal use only. Personal use means non-commercial use of the image(s) for display on personal web sites and computers, or making prints for personal use. The image(s) may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration. The image(s) may not be used in advertising. The image(s) may not be resold, relicensed, or sub-licensed.
• The Copyright and Warranty notices contained in these conditions apply to the Personal License.
Commercial License
What you may do: The Photographer, Leonard John Abrams, will grant a license with specified conditions of use of the image(s) for commercial purposes. The license may be time bound and will usually be non-exclusive, non-transferable, and location specific. Permitted commercial purposes will be specified and may include:
• advertising, promotion, brochures, packaging
• as part of a commercial web site for promotional purposes
• prints, posters, flyers, tearsheets or other commercial display of image for promotional purposes (not for resale)
• magazines, books, newspapers, other printed publications
for commercial promotional purposes
What you may not do: Buyer may not resell, relicense, redistribute without express written permission from photographer. Use as a derivative work, and reselling or redistributing such derivative work is prohibited. Images may not be used in a pornographic, obscene, illegal, immoral, libelous or defamatory manner. Images may not be incorporated into trademarks, logos, or service marks. Image may not be made available for download.
The Copyright and Warranty notices contained in these conditions apply to the Commercial License.
Copyright
Photographer Leonard John Abrams exclusively retains all rights, license, copyright, title and ownership of the image(s).
Where image(s) are used on web sites, each web page containing an image purchased under these conditions will carry a clearly legible notice ascribing copyright of the images to the Photographer.
Warranty
There is no warranty, express or implied, with the purchase of digital image files or printed image materials. The image(s) are provided "as is". The photographer will not be liable for any claims, or incidental, consequential or other damages arising out of this license or buyers use of the image(s). Unless otherwise provided for, all images are provided without Model or Property Releases.
